Art. 1 - General provisions
- The user browsing in this area accesses vibrasonic.it, accessible via the url: www.vibrasonic.it. Browsing and placing a purchase order on the site imply acceptance of the Conditions and Data Protection Policies adopted by the site itself indicated therein.
- These General Conditions of Sale apply to the sale of products with exclusive reference to purchases made on the site in accordance with the provisions of Part III, Title III, Chapter I, Consumer Code (Legislative Decree no. 206/05 amended by Legislative Decree no. 21/14 and Legislative Decree 70/03) by

- The user is required, before accessing the products supplied by the site, to read these General Conditions of Sale which are generally and unequivocally accepted at the time of purchase.
- The user is invited to download and print a copy of the purchase form and these General Conditions of Sale whose terms Vibrasonic.it reserves the right to modify unilaterally and without notice.
Art. 2 - Object
- These General Conditions of Sale regulate the offer, acceptance and execution of sales contracts concluded between the buyer (hereinafter referred to as "Customer" or "Purchaser") and the authorized dealer (hereinafter referred to as "Dealer" or "Our Company") through our online shop.
Art. 3 - Products and Catalogue
3.1 The Reseller provides the Customer with a catalogue of products on the online shop, containing an accurate description of the products, their technical specifications, prices and information on availability.
3.2 All products in the online catalogue are sold as an authorised reseller, guaranteeing the authenticity and origin of the products themselves.
Art. 4 – Orders
4.1 The Customer can place purchase orders for the products in the online catalogue by filling out the appropriate order form on the website. The sending of the order by the Customer represents a binding purchase offer for the Reseller.
4.2 The Reseller reserves the right to accept or refuse the Customer's order, at its discretion. Acceptance occurs by sending an order confirmation to the Customer by email or by starting the execution of the contract (for example, the preparation and shipment of the purchased products).
Art. 5 – Personal data
5.1 The personal information requested under the order is collected and processed to meet the requirements expressed by the Customer and will not be managed by third parties under any circumstances. The Supplier guarantees its customers compliance with the rules on the processing of personal data covered by the Privacy Code pursuant to Legislative Decree 196 of 30.06.2003. Personal data is collected for the purpose of registering the customer and providing him with the procedures for the execution of this contract and the necessary communications; this data is processed electronically in accordance with the laws and can only be produced upon request of the judicial authority or other legitimate authorities.
Art. 6 - Product Availability
6.1 The supplier guarantees the fulfillment of orders without delay. If the instrument has been requested in an unavailable scale, the customer will access the waiting list. The Supplier will inform the Customer of the waiting time to obtain the chosen goods, regardless of whether the Customer confirms the order or not. After confirmation of the order, the Customer undertakes to pay a deposit of 30% of the value of the instrument, no later than 15 days from confirmation of the same, in the absence of which the request may be canceled. In the event of withdrawal by the Customer from the purchase of the reserved product, the deposit is not refundable.
Art. 7 - Prices and Payments
7.1 The information relating to the prices of the products in the online catalog are indicated in local currency and include all applicable taxes and charges. Any shipping costs or additional costs will be specified during the checkout process.
7.2 Payment for the products can be made through the payment methods indicated on the online shop. The Retailer reserves the right to request additional information or documents to verify the Customer's identity or for security purposes.
7.3 Purchases can be made through the payment methods clearly indicated on the website www.vibrasonic.it. Credit cards or cash are accepted in our showroom.
Art. 8 - Delivery
8.1 Delivery is generally made between 2 and 5 working days, from receipt of payment.
In the event that the Supplier is unable to ship within this period of time, the Customer will be promptly notified via email. If the chosen product is not available, the Supplier will inform the Customer of its positioning on the waiting list and the times for If it is not possible to make the delivery, the order will be sent to the warehouse. In this case, a notice will specify the location of the order and the methods for agreeing a new delivery.
8.2 Shipping costs are the responsibility of the buyer and are explicitly highlighted at the time the order is placed.
8.3 The Retailer undertakes to deliver the products ordered to the Customer to the shipping address provided during the checkout process. Shipping methods, delivery times and any geographical restrictions will be indicated on the shipping information page.
Art. 9 - Passage of risk
9.1 The risk of loss or damage to the products passes to the Customer upon delivery. It is the Customer's responsibility to carefully check the integrity of the products upon delivery and to report any damage or defects to the Retailer.
Art. 10 - Warranty and assistance
10.1 The supplier is responsible for any lack of conformity that occurs within a period of two years from delivery. All purchased products have a warranty pursuant to Legislative Decree no. 206/2005. The warranty covers the repair or free replacement of the instrument in the event of manufacturing defects. Scratches, color differences, hammering on the instrument necessary to tune the notes and any slight asymmetry are due to the artisanal nature of the products and should not be considered defects. All our instruments are heat treated. However, the possibility of rust formation is not excluded and the acrylic coloring may disappear over time. Retuning the instrument can vary from 50 to 200 euros, depending on the number of notes to be repaired. Shipping costs are at the buyer's expense.
The warranty does not cover accidental damage and/or shock or damage resulting from loss. The Supplier also declines any liability for any damage that may arise directly or indirectly to persons, things or animals from failure to comply with the instructions provided by the Supplier regarding the use and maintenance of the product.
10.2. The Customer has no rights when informing the Supplier of the lack of conformity beyond a period of one month from the date on which the defect was discovered.
10.3. In the event of manufacturing defects, the Customer may request, alternatively and free of charge, under the conditions specified below, the repair or replacement of the purchased item, a reduction in the purchase price or the termination of this contract.
10.4. The request must be sent in writing, by registered mail with return receipt or registered mail, to the Supplier, who will indicate his willingness to act on the request or the reasons that prevent him from doing so within seven days of receipt. In the same communication, where the Supplier has accepted the Customer's request, he must indicate the method of delivery or return of the property as well as the deadline for the return or replacement of defective goods.
10.5. The repair/retuning of the instrument is at the Customer's expense. The assessment of the time and amount required for the repair/retuning will be made by the supplier upon receipt of the goods.
RIGHT OF WITHDRAWAL
11.1. Purchases on our site are subject to the provisions of the Italian Legislative Decree. 206/2005 (Consumer Code), imposed in relation to distance contracts, in cases where the delivery of the goods takes place at the residence or the place indicated by the Customer, as such purchases are concluded outside of commercial premises.
The Customer has the right to withdraw from the contract within the conventional term of 15 days from receipt of the goods, returning the purchased product to the seller. It should be noted that in the event that the purchase of a product is combined with another good sold at a very low price or even free, the right of withdrawal will be legitimately exercised with the return of both goods, given the incidental nature of the connection.
The legislation provides that the right of withdrawal can only be exercised by subjects (consumers) who act for purposes other than their own business. The right of withdrawal, therefore, cannot be exercised by legal persons and subjects acting for purposes related to a business. Purchases made by retailers or by those who purchase in any way for resale to third parties are also excluded from the right of withdrawal. It is necessary to have the following components, documents and data:
- original packaging, intact and complete with all its parts;
- original invoice;
At this point you can contact the Supplier via the contact details on the Website, who will inform you of the steps to take to open the withdrawal procedure, simultaneously giving you authorization to return the goods.
After activating the withdrawal procedure, it is necessary to include the original envelope containing the goods in suitable packaging, in order to protect the original covers of the products from any damage or alteration. The Supplier reserves the right to refuse the goods received in conditions that are not consistent with the procedure described above.
The goods will be shipped by the Customer at his own expense within 10 days of the return communicated by the Supplier (art. 67 Legislative Decree 206/2005).
The Supplier reserves the right from now not to accept shipments of components or products that:
- Do not contain original packaging and accessories;
- Have been carried out without activating the request for intervention to the Supplier;
- Have been carried out without following the shipping procedures indicated by the Supplier.
In such cases, the transport costs relating to both shipping and return will be borne by the Customer
JURISDICTION
12.1. The sales contract between the Customer and the Supplier is concluded in Italy and governed by Italian law.
12.2. For the resolution of civil and criminal disputes arising from the conclusion of this sales contract, the local jurisdiction is the sole court of Padua.
PRIVACY POLICY ART. 13 OF LEGISLATIVE DECREE NO. 196/2003
"SVILUPPATI S.r.l. Unipersonale" informs its customers that:
- Personal data are necessary to process orders. Failure to consent to the processing of data for promotional and/or sales means does not affect the purchase request.
- The data may be used for marketing operations. The data will not be disclosed to third parties.
- The data is processed using manual, computerized and data tools, by the Supplier and/or its representatives. In any case, the processing is strictly related to the purposes mentioned above, however, in order to guarantee the security and confidentiality of the data, which will be managed and protected in areas where access is constantly controlled.
- The data controller is " SVILUPPATI S.r.l.", with headquarters in Albignasego in Via Roma 35/2.
- In relation to the processing of such data, the customer, pursuant to art. 7 of Legislative Decree. 196/2003 has the right to obtain from "SVILUPPATI S.r.l.":
1- confirmation of the existence or otherwise of your personal data, their communication in an intelligible form and knowledge of their origin and the logic on which the processing is based;
2 - The cancellation, within a reasonable time, of their data, their transformation into anonymous form or the blocking of data processed in violation of the law;
3 - updating of the data, their correction or, if interested, their integration;
The customer also has the right to object for legitimate reasons to the processing of personal data concerning him, even if pertinent to the purpose of the collection.
